Premarital Agreement

Between Maya Reyes and Daniel Kim · Travis County, Texas · Made under Chapter 4 of the Texas Family Code

1. Parties and purpose

Maya Reyes (“Maya”) and Daniel Kim (“Daniel”) intend to marry on or about June 12, 2027. They make this agreement so that, during the marriage and if it ends, their property and financial responsibilities are governed by the terms below rather than solely by the default rules of Texas law.

In plain English: this says who you are, when you plan to marry, and that you’d rather set your own rules than use the state’s defaults.

2. Full disclosure

Each party has provided the other with a fair and reasonable disclosure of their property and financial obligations, set out in Schedule A (Maya) and Schedule B (Daniel), both attached and signed. Each party has had the opportunity to ask questions about the other’s disclosure and to consult an independent attorney.

In plain English: you both showed each other what you own and owe, and each of you could have had a lawyer look at it. This is one of the three things that make a Texas prenup hold up.

3. Property owned before the marriage

3.1 The condominium at 1420 Elm Street, Austin, owned by Maya before the marriage, shall remain her separate property, including any increase in its value. Mortgage payments made during the marriage from community funds do not change that; the community shall have no claim for reimbursement.

3.2 Funds held by either party on the date of marriage, as listed on that party’s Schedule, shall remain that party’s separate property, together with interest and growth on those funds.

In plain English: Maya’s condo stays Maya’s, and what each of you saved before the wedding stays yours, including what it earns.

4. Income and property acquired during the marriage

4.1 Except as provided in this agreement, income earned by either party during the marriage, and property acquired with it, shall be community property.

4.2 Any residence the parties purchase together during the marriage shall be community property owned in equal shares, regardless of the source of funds used for the down payment.

In plain English: salaries during the marriage are shared, and a home you buy together is yours together, fifty-fifty, even if one of you put in more for the deposit.

5. Debts

5.1 The student loan obligations listed on Daniel’s Schedule B shall remain his sole and separate debt. Maya shall have no liability for them. If community funds are used to pay them, the community shall be reimbursed on request at the end of the marriage.

5.2 Debts incurred jointly during the marriage shall be community debts.

In plain English: Daniel’s loans stay Daniel’s. If you pay them from a joint account, that can be settled up later.

6. Spousal maintenance

Each party waives any right to spousal maintenance from the other, to the extent permitted by Texas Family Code Chapter 4, except that this waiver shall not apply if enforcing it would leave a party eligible for public assistance at the time of separation.

In plain English: neither of you plans to ask the other for support after a divorce. Texas lets you agree to this, with one limit a court can enforce.

7. Inheritance and gifts

Property received by either party by gift or inheritance during the marriage shall remain that party’s separate property, together with its income and growth.

8. Governing law and review

8.1 This agreement is governed by the laws of the State of Texas, regardless of where the parties later live.

8.2 The parties may amend or revoke this agreement only by a written agreement signed by both of them. They intend to review it together on or about their fifth anniversary.

In plain English: Texas law applies even if you move, and you can change this later, but only in writing and only if you both sign.

9. Voluntary signing

Each party confirms that they have read this agreement, understand it, sign it voluntarily, have had at least seven days between receiving the final text and signing it, and have been advised that each may consult an independent attorney of their choosing.

In plain English: nobody rushed anybody. You both had time to read it and the option to get your own lawyer.
